Terms and Conditions (GTC)

    • On the basis of these General Terms and Conditions (GTC), an agreement is reached between the customer and EQUINISTA, represented by Birgit Schrenk, Bahnhofstraße 14, 18055 Rostock, Tel: +49 381 5108631 , email address: info@EQUINISTA.eu, hereinafter referred to as the provider Contract concluded.
    • Subject of the contract
      This contract regulates the sale of new goods and services via the provider's online shop. For details of the respective offer, please refer to the product description on the offer page.
    • Conclusion of contract
      The contract is concluded in electronic commerce via the shop system or via other means of distance communication such as telephone and email. The offers presented represent a non-binding invitation to submit an offer through the customer order, which the provider can then accept. The ordering process to conclude the contract includes the following steps in the shop system: Selecting the offer in the desired special specification and custom-made product (size, color, number) - Placing the offer in the shopping cart - Pressing the 'order' button - Entering the billing and delivery address - Selection of the payment method - Checking and processing the order and all entries - Pressing the 'order for a fee' button - Confirmation email that the order has been received. In addition to the shop system, orders can also be placed via remote communication means (telephone/e-mail), whereby the ordering process to conclude the contract includes the following steps: Calling the EQUINISTA studio / sending the order email - confirmation email that the order has been received. The contract is concluded when the order confirmation is sent.
    • Contract duration
      The contract is concluded for an indefinite period.
    • Retention of title
      The delivered goods remain the property of the provider until full payment has been made.
    • Reservations
      The provider reserves the right not to provide the promised service if the promised service is not available.
    • Prices, shipping costs, return costs
      All prices are final prices and include statutory sales tax. The following shipping costs are charged once per order:
    • Germany / Austria / Denmark incur a one-off shipping fee of €6.99.

      If you would like to order horse feed such as muesli, postage costs of €6.99 per unit will also be charged.

      Switzerland: One-off shipping costs of CHF 20.00 apply to an order.

      Luxembourg: When placing an order, a one-off shipping fee of €15.00 will be charged.

    • If there is a right of withdrawal and this is used, the customer bears the costs of the return.
  • Payment terms
    The customer only has the following payment options: advance transfer, payment service provider PAYPAL, PAYPAL PLUS, Apple Pay, Google Pay, Shop Pay, Maestro, Visa, Mastercard, American Express, instant transfer, Klarna invoice, Klarna Pay Now, eps transfer, cash payment upon pickup. No other payment methods are offered and will be rejected. The invoice amount must be transferred in advance to the account specified there after receipt of the invoice, which contains all the information for the transfer and is sent by email. When using an escrow service/payment service provider, this enables the provider and customer to process the payment between themselves. The escrow service/payment service provider forwards the customer's payment to the provider. Further information can be found on the website of the respective escrow service/payment service provider. The invoice amount can also be paid in cash at the provider's business premises during normal office hours, after deducting the shipping costs taken into account. When paying by credit card, the customer must be the cardholder. The credit card will be charged after the goods are ordered. The customer is obliged to pay or transfer the amount shown to the account specified on the invoice within 7 days of receiving the invoice. Payment is due from the invoice date without deductions. The customer is only in default after a reminder. Offsetting against customer claims is excluded unless they are undisputed or legally established.
  • delivery terms
    The goods will be dispatched immediately after confirmed receipt of payment. Shipping takes place on average after 28 days. The standard delivery time is 42 days unless otherwise stated in the item description. The provider either ships the order from its own warehouse as soon as the entire order is in stock there, or the order is shipped from the manufacturer as soon as the entire order is in stock there. The customer will be informed immediately of any delays. If the provider is not responsible for a permanent obstacle to delivery, in particular force majeure or non-delivery by its own supplier, even though a corresponding hedging transaction was carried out in a timely manner, the provider has the right to withdraw from a contract with the customer. The customer will be informed immediately and any services received, in particular payments, will be refunded.

  • Warranty
    Consumers have a legal right to liability for defects for the services offered in accordance with the relevant provisions of the German Civil Code (BGB). If this is deviated from, the warranty is based on the relevant regulations in the General Terms and Conditions (GTC). If the customer is an entrepreneur, the warranty period for new goods is limited to one year. The provider is granted the right to choose between repair or new delivery in the event of subsequent performance if the goods are new and the customer is an entrepreneur. If the customer is an entrepreneur, the warranty is excluded for used goods. If the customer is a consumer, the warranty period for used goods is limited to one year. This does not apply to the customer's claims for damages due to injury to life, body, health or essential contractual obligations, which must necessarily be fulfilled in order to achieve the contractual objective. This also does not apply to claims for damages resulting from grossly negligent or intentional breach of duty by the provider or his legal representative or vicarious agent. Otherwise, the statutory provisions apply.
  • Contract drafting
    The provider grants the customer a discount of 2% if payment is made within 2 days of the invoice being issued. If the customer is an entrepreneur, the risk of accidental loss and/or accidental deterioration of the goods is transferred to the customer upon handover, or when the goods are dispatched to the selected service provider. The contract text is saved by the provider. The customer has the following option to access the saved contract text: The customer has the opportunity to view the contract text/order themselves in their own log-in area (My Account).   • Disclaimer
    Claims for damages by the customer are excluded unless otherwise stated for the following reasons. This also applies to the provider's representatives and vicarious agents if the customer asserts claims for damages against them.     The customer's claims or rights against the provider may not be assigned or pledged without the provider's consent, unless the customer has demonstrated a legitimate interest in the assignment or pledge.
  • Language, place of jurisdiction and applicable law

    The contract is written in German. The further implementation of the contractual relationship takes place in German. The law of the Federal Republic of Germany applies exclusively. For consumers, this only applies to the extent that it does not restrict any legal provisions of the country in which the customer has his or her usual place of residence. The place of jurisdiction for disputes with customers who are not consumers, legal entities under public law or special funds under public law is the registered office of the provider.

    In connection with the initiation, conclusion, processing and reversal of a purchase contract based on these General Terms and Conditions, data is collected, stored and processed by the provider. This happens within the framework of the legal provisions. The provider does not pass on the customer's personal data to third parties unless it is legally obliged to do so or the customer has expressly consented in advance. If a third party is used for services in connection with the handling of processing processes, the provisions of the Federal Data Protection Act will be complied with. The data provided by the customer when placing the order will be processed exclusively for contact purposes within the scope of contract processing and only for the purpose for which the customer provided the data. The data will only be passed on to the shipping company that delivers the goods in accordance with the order if necessary. The payment data will be passed on to the credit institution responsible for the payment. If the provider is subject to retention periods due to commercial or tax law, the storage of some data can take up to ten years.     The ineffectiveness of a provision of these General Terms and Conditions has no impact on the effectiveness of the other provisions.
